Official Rules for Tangerine Room’s Social Media Giveaway January 2025

NO PURCHASE REQUIRED TO ENTER OR WIN

Any individual who enters, attempts to enter or in any way participates or attempts to participate in any contest, sweepstakes or giveaways (“Giveaway”) conducted by The Westin Anaheim Resort (hereinafter referred to as the “Sponsor”) (each such individual in hereinafter referred to as an “Entrant”) agrees to be bound by the terms and conditions provided in these Official General Giveaway Rules (“General Rules”), as well as by Sponsor’s interpretations of these General Rules which are final and binding in all matters relating to any Giveaway.

NO PURCHASE NECESSARY: Unless otherwise noted, no purchase is necessary to enter or win a prize. A purchase, if one is available, will not improve your chances of winning.

APPLICABLE LAW (VOID WHERE PROHIBITED): All Giveaways are subject to and governed by applicable federal, state and local laws and regulations. Participation in this Giveaway is void where prohibited or otherwise restricted by law.

1. SPONSOR

Tangerine Room’s Social Media Giveaway January 2025 (“Giveaway”) is sponsored by The Westin Anaheim Resort (“Sponsor”).

2. ELIGIBILITY

The Giveaway is open to those who are at least 18 years old at the time of entry. Only one individual’s name may be associated with each entry.

Employees, contractors, officers and directors of Sponsor, its affiliates, parent companies, subsidiaries, divisions, suppliers, vendors, distributors and advertising, promotional and judging agencies, and any third party prize provider(s) and/or prize fulfillment service (collectively, the “Giveaway Entities”); individuals employed by The Westin Anaheim Resort; and members of the immediate families (spouse and biological, adoptive or step-parents, grandparents, children, grandchildren and siblings, and each of their respective spouses regardless of where they reside) or households (whether related or not) of any of the above individuals are not eligible to participate in the Giveaway or win any prize.

3. AGREEMENT TO OFFICIAL RULES

Participation in the Giveaway constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning the Giveaway is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. The Sponsor reserves the right to disqualify a participant if the Giveaway rules are violated in any way. Official Rules are available during regular business hours at 1030 West Katella Avenue, Anaheim, California 92802. Official Rules will be provided upon request. Official Rules are subject to change without notice.

4. GIVEAWAY PERIOD

The Giveaway is between January 1, 2025, 12:00 AM to January 31, 2025, 11:59 PM Pacific Standard Time. Entries may not be made before or after the official Giveaway period. Entries made outside of the official Giveaway period will be disqualified. Entries will be accepted for the duration of the Giveaway period only.

5. HOW TO ENTER

NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN

Entrants must enter by posting a picture of themselves on Instagram at Tangerine Room restaurant or at Bar 1030 at The Westin Anaheim Resort, 1030 West Katella Avenue, Anaheim, CA 92802. Their post must be public, must contain an @ mention of @tangerineroomrestaurant in the caption, and @tangerineroomrestaurant must be tagged in the photo. Entrants must fully complete and submit their post to enter. The Sponsor and its respective directors, officers, employees, and members assume no responsibility for incorrect, invalid, terminated, or non-functioning e-mails or lost, incomplete, late, illegible or undelivered entries. The Giveaway is void where prohibited by law.

6. PRIZE

Tangerine Room’s Social Media Giveaway January 2025 has one prize winner. The winner will receive the following prize from the Sponsor, to be used at Tangerine Room:

• One certificate of $150.00 USD to be used exclusively at Tangerine Room at The Westin Anaheim Resort. The retail value of the Prize is $150.00 USD. There is no cash prize or alternative prize.

Winners will receive their Prize, subject to payment by the winner of all applicable taxes, and subject to the additional details and restrictions as provided herein. The Sponsor and their respective parents, subsidiaries, affiliates, and other companies associated with the Giveaway make no claims of merchantability of the Prize.

7. GIVEAWAY ODDS

The odds of being selected as the winner depend on the number of entries into the Giveaway. If 100 entries are made and only a single entry is made by each entrant, the odds of being a winner are 1:100.

8. PRIZE DRAWING

The winner of the Giveaway will be determined on or about February 3, 2025, by random drawing. Giveaway entrants need not be present to win.

The winner will be notified by a direct message from @tangerineroomrestaurant Instagram account to the winner’s photo submission on the winner’s Instagram account on or around February 13, 2025. Giveaway entrants need not be present to win.

9. WINNER NOTIFICATION

The winner will be contacted within 10 business days of the Giveaway end. By claiming the Prize, the winner releases the Sponsor and their officers, directors, members, employees, subsidiaries, and affiliates from any and all claims, liabilities, and/or damages arising directly or indirectly out of the award and/or use of their Prize. The Sponsor is not responsible for illness, death or injury which may be sustained in conjunction with participation in the Giveaway and/or the use of a Prize awarded.

Sponsor will make three (3) attempts to contact each potential winner by the method described above within one (1) business day from the day the potential winner’s name is drawn. If the Prize is not claimed within one (1) day of Sponsor’s last attempt to contact the winner or Sponsor is unable to reach a potential winner by the method described above within such time, Sponsor may, in its sole discretion, disqualify that winner and an alternate potential winner’s entry will be drawn from all remaining eligible entries. Sponsor shall have no liability for any winner notification that is lost, intercepted, or not received by a potential winner for any reason.

10. GENERAL CONDITIONS

In the event that the operation, security, or administration of the Giveaway is impaired in any way, for any reason, including but not limited to fraud or unauthorized human intervention or other technical problems, or in the event that the Giveaway is unable to run as planned for any other reason, as determined by the Sponsor in their sole discretion, the Sponsor may, in their sole discretion, either a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules or b) award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right at their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the legitimate operation of the Giveaway. Such activities may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. Decisions of the Sponsor are final.

11. RELEASE AND LIMITATIONS OF LIABILITY

Giveaway participants agree to release and hold harmless the Sponsor and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Giveaway, and each of their respective officers, directors, employees, shareholders, representatives, and agents (“Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt and/or use of a Prize. This includes but is not limited to:

1. Technical errors associated with the Giveaway, such as lost, interrupted, or unavailable Internet Service Provider (ISP) access, or network, server, wireless service provider, or related connection errors. Said technical errors may also include the unavailability, limited accessibility, or miscommunication of a failed computer, satellite, telephone, cellular tower, or cable transmission line, or a technical failure or jumbled, scrambled, delayed, or misdirected transmission or computer hardware or software malfunction, or failure;
2. Unauthorized human intervention in the Giveaway;
3. Mechanical, electronic, human, and printing and/or typographical errors;
4. Application downloads and/or failures;
5. Any other errors or problems pertaining to the Giveaway, including, without limitation, errors that may occur in the administration of the Giveaway, the announcement of the winner, the cancellation or postponement of the event, or the incorrect downloading and processing of entries or any Giveaway related materials;
6. Injury, death, loss, or damage of any kind, to persons and/or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Giveaway or acceptance, receipt, or misuse of a Prize (including any travel or activity related thereto). Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall an entrant be entitled to receive attorney’s fees; and/or
7. Incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. DISPUTES

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Orange County, California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.

13. COMPLIANCE WITH LAW AND GOVERNING LAW.

All issues and questions concerning the construction, validity, interpretation and enforceability of the Giveaway Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 11 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of California, in the City of Anaheim.

14. FINANCIAL OBLIGATION

The winner assumes the financial obligation for local, state and federal taxes and all applicable fees based on the value of their Prize. In accordance with IRS regulations, the Prize winners will be furnished an IRS Form 1099 (miscellaneous income). For additional information, winners should consult their tax advisor. The winner will be entirely and solely responsible for paying any such taxes. No other fees, taxes and/or penalties will be paid by the Sponsor in connection with the Giveaway unless specifically outlined in these rules.

15. PRIZE DETAILS/RESTRICTIONS

1. Winner cannot gift the Prize or any part of the Prize to a 3rd party.
2. Prize is to be used at Tangerine Room at The Westin Anaheim Resort, located at 1030 West Katella Avenue, Anaheim, California 92802.
3. Prize is subject to blackout dates.
4. Prize must be redeemed by December 31, 2025.
